What does MTPL insurance imply?

MTPL insurance covers civil legal liability for damage caused to third persons by driving the motor vehicle, which practically means that this will not be paid by a driver, but by the insurance company which issued the policy.

Does my policy of MTPL provide cover for damage of my vehicle?

No. Your policy of MTPL covers only damages you caused to third persons by using your vehicle.

If I have caused a damage driving a vehicle that does not belong to me, who is going to pay for it?

The effect of MTPL insurance is connected to the vehicle and not to the person who drives it. So, the damage will be paid by the insurance company that issued the MTPL policy for the respective vehicle. It does not matter who was the driver of the vehicle, as long as the policy vas valid at the time of loss occurrence.

To what amount will the insurance company pay the damage caused by my vehicle?

The law stipulates that the lowest amount to which the MTPL insurance must be concluded for buses and motor trucks is USD 200,000 and for other motor vehicles USD 100,000. The insurance company charges MTPL premium in line with the tariff system that is adjusted to the above stated sums insured. The insurance company with who you have taken out MTPL policy is obliged to indemnify loss caused by your car at the time of insurance validity up to the amount of USD 100,000 per one loss. If the damage exceeds this amount, you will indemnify the difference between the amount of USD 100,000 and the actual amount of damage.

Can I get indemnified if a vehicle caused a damage from abroad?

Yes, by submitting a claim to any domestic insurance company. If you had a traffic accident, we recommend that you provide a photocopy of the green card of a person who had caused damage as well as an investigation report of the traffic police. If you are not able to provide the photocopy of the green card, it is necessary to copy in writing all data from the card, particularly its number, name of the insurance company that issued the card, period of validity, name and surname of the person to whom it was issued and data on motor vehicle for which it was issued.

Can I get indemnified if the damage was caused by an unregistered (uninsured) vehicle?

Yes, but only in case the vehicle that caused the damage is subject to compulsory MTPL insurance according to the Law on insurance of persons and property. These vehicles include passenger cars, trucks and buses.

Such damages are paid from the Guarantee fund with the Association of insurance companies of Serbia and Montenegro through the insurance company to which you have submitted your claim.

Can I get indemnified if the damage was caused by an unknown vehicle?

Yes, but only a non-material damage (death, body injuries, health deterioration, etc). Such damages are paid from the Guarantee fund with the Association of insurance companies of Serbia and Montenegro through the insurance house to which you have submitted your claim.

Are there any dangers if take out MTPL with the unreliable insurer, although he offers "better" conditions of premium payment?

Yes, there are dangers. On the basis of the current law regulations, if an insurance company that issued MTPL policy ceases to exist (which is not unusual nowadays) you are obliged to take out, within eight days from the date on which the suspension of the insurance company was published in the public news media, another MTPL policy from the insurance company which still exists. Naturally, you will have additional expenses for purchasing new policy; but it is more dangerous if you do not buy it. In that case, your vehicle formally becomes uninsured and if you cause damage with this vehicle, it will be indemnified from the Guarantee fund with the Association of insurance companies of Serbia and Montenegro. However, eventually you will be obliged to pay the complete damage together with interest and other expenses through a recourse action.

Besides the above stated and in case that your insurance company still exists, but is unreliable one, the solicitors of the person that suffered the damage often initiate proceedings against you, thus exposing you to additional court and solicitors expenses.

Why do I need a green card and why should I take it out with "DDOR Novi Sad"?

However, in case our citizen suffers damage in the visited country due to the fault of a citizen of this country, the green card formally is of no importance. In such situation, we advise you to provide the investigation report of the police of the visited country and submit the claim for damage to the insurance company where the liability of the person that caused the damage is insured and that should indemnify the damage.
